Work Permit
A work permit is a written authorization to work in Canada issued by an officer to a person who is not a Canadian citizen or a permanent resident of Canada. It is required if the employment location is in Canada, whether or not the employer is in Canada. The program was created by Immigration, Refugees and Citizenship Canada (IRCC) to deal with shortages in the labour market by helping Canadian employers find and recruit foreign employees to work in Canada.
Eligibility Requirements
To be eligible to apply for a work permit in Canada, you need:
- Prove to an immigration officer that you will leave Canada when your work permit expires.
- Show that you have enough funds to take care of yourself and your family members while you are in Canada and to go return home.
- Obey the law and have no record of criminal activity.
- Not be a danger to Canada’s security.
- Be in good health and have a medical exam, if needed.
- Provide any additional documents as required.
Open Work Permit
An open work permit allows you to work for any employer in Canada, except for an employer who:
- Is listed as ineligible on the list of employers who have failed to comply with the conditions or
- Regularly offers striptease, erotic dance, escort services or erotic massages
Employer-Specific Work Permit
An employer-specific work permit allows a foreign worker to work for a specific employer for a certain amount of time. You are allowed to work according to the conditions on your work permit, which include:
- The name of the employer you can work for
- The duration of your employment
- The location of where you can work (if applicable)
Most employers need a Labour Market Impact Assessment (LMIA) before they can hire a temporary foreign worker. A LMIA is a document that confirms there is a need for a foreign worker to fill the job and that no Canadian citizen or permanent resident is available to do the job.
There are dozens of LMIA Exemptions available, most common are work permits covered under NAFTA, GATS and Intra-Company Transfer provisions. They do not require a Labour Market Impact Assessment. LMIA-Exempt work permits are still employer, location and occupation specific.
